(g) Nothing in this section permits the production of beer, mead, cider, or table wine in a dry community as defined in Title 28, Chapter 3, the Alabama Code of 1975. Except for wet communities, as defined in Chapter 3 of Title 28 of the Alabama Code of 1975, nothing in this section permits the production of beer, mead, cider or table wine in a dry county as defined in Chapter 3 of Title 28, Alabama Code 1975. (a) Every person who manufactures or corrects an alcoholic beverage without holding a manufacturer`s licence, or who owns a distillery without holding a manufacturer`s licence, is guilty of an offence and liable to a fine of not more than $1,000, imprisonment for a term not exceeding one year, or both. All devices that are illegally held and used will be confiscated by the state and disposed of according to the instructions of the court. This subsection does not apply to the production of homemade beer, mead, wine and fermented fruit juice if the sum of the beer, mead, wine and fermented fruit juices produced in a calendar year does not exceed: (i) 100 gallons in a household where the person is 21 years of age or older; or (ii) 200 gallons in a household of two or more persons 21 years of age or older. (b) Beer, mead, cider or table wine produced in accordance with this Act shall not be sold or offered for sale.

Under this Title, no licence or authorization is required for the production of craft beer and the possession, transportation or storage of craft beer by any person if: (A) the person who makes the beer does not receive compensation; (B) the beer is not sold or offered for sale; and (C) the total quantity of beer produced in a calendar year by the individual and another person living in the same household does not exceed 100 gallons if there is only one person of legal drinking age in the household, or 200 gallons if the household has two or more people of legal drinking age. 2. A person who produces, holds, transports or stores beer in accordance with the restrictions referred to in point (b)(1) shall not be a producer of beer within the meaning of this Chapter. 3. Any craft beer referred to in point (b)(1) transported shall be clearly labelled as home-made beer. (4) Craft beer produced in accordance with the restrictions in subsection (b)(1) may be consumed by the person who produced it and his or her family, neighbours and friends in any private residence or other private place where the possession and consumption of beer is permitted under this chapter, local ordinances or other applicable laws.
This subsection (b)(4) does not apply to licensed premises within the meaning of this Chapter. Although sometimes referred to as honey wine, mead is a separate class of beverages. Homemade beers, mead, wines and fermented fruit juices stored for the event must be clearly labelled and kept separate from the licensee`s liquor and malted beverage inventory. Nothing in this subsection prohibits the licensee from using homemade beer, mead, wine and fermented juice to organize an event in accordance with paragraph (a) of this section. 6. The total annual production of beer in such a centre for all persons producing beer on such premises shall not exceed, in accordance with a licence for custom beer manufacturing centres, the production limits established by the Authority that correspond to a non-commercial production facility. In 1978, Congress enacted Public Law 95-458 (H.R. 1337), which amended the Internal Revenue Code to allow any adult to produce beer for personal or family use without paying taxes. Beer produced per household must not exceed: (1) 200 gallons per calendar year if there are two or more adults in the household, or (2) 100 gallons per calendar year if there is only one adult in the household.
